1. About these terms
These Terms & Conditions govern access to TictacBazar.com and the purchase, download and use of software, plugins, themes, documentation and related digital content offered through the website.

By creating an account, placing an order or downloading a product, you agree to these terms.
2. Eligibility
You must have the legal capacity to enter into a binding agreement.
If you purchase on behalf of a company or another organisation, you confirm that you are authorised to bind that organisation to these terms.
3. Products and product information
TictacBazar.com supplies digital software products intended primarily for Osclass and Joomla websites.
Each product page may specify:

supported platform and version;
-
technical requirements;
-
included features;
-
current product version;
-
licence scope;
-
update period;
-
documentation or support included;
-
price and applicable taxes.
You are responsible for checking the stated requirements and compatibility before purchasing.
Product screenshots and demonstrations illustrate the product at the time they were prepared. Minor visual differences may result from platform versions, themes, third-party extensions or website configuration.
4. Customer accounts
An account may be required to purchase, access or download a product.
You must provide accurate information, maintain the confidentiality of your password and promptly notify us if you suspect unauthorised access.
You are responsible for activity performed through your account unless it results from a security failure for which we are legally responsible.
Accounts and download access may not be sold, shared publicly or transferred to another person without written permission.
5. Prices, taxes and payment
Prices are displayed in the currency shown on the website. The final amount, including any applicable taxes or additional charges, is displayed before payment.
Payments are processed through Stripe.
Depending on the transaction and customer location, Stripe may act as a payment processor or, through Stripe Managed Payments, as the merchant of record. The relevant payment entity and transaction details are identified during checkout and on the payment confirmation.
An order is accepted when payment is successfully confirmed and the corresponding download entitlement is issued. We may cancel or refund an order where payment cannot be verified, fraud is reasonably suspected or the product cannot be supplied.
6. Digital delivery
Products are delivered electronically through the customer account or a secure download link after successful payment confirmation.
You are responsible for:

using a valid email address;

maintaining access to your account;
-
downloading the purchased files within a reasonable time;
-
keeping a secure backup of the downloaded product.
Temporary interruptions caused by maintenance, hosting incidents or payment confirmation delays do not constitute a failure to deliver where access is restored within a reasonable period.
7. Software licence
Unless a product page or order confirmation expressly states otherwise, each purchase grants you a limited, non-exclusive, non-transferable licence to install and use the product on:

one production website; and
-
one private development or staging installation used for that production website.
You may:
-
make reasonable modifications for your own licensed installation;

create backup copies;
-
use the product for your own website or for a client website covered by a valid licence.
You may not:
-
sell, sublicense, rent or redistribute the product;
-
share the product files or download links publicly;
-
provide the product as part of a competing plugin, theme, template or software package;
-
remove copyright, licence or attribution notices where their retention is required;
-
use one licence for multiple unrelated production websites;
-
claim ownership of the original product or its proprietary components;
-
use the product in violation of law or third-party rights.
Modifying a product does not transfer ownership of the original product or permit redistribution of the modified version.
Third-party components remain subject to their respective licences and notices included in the product package.
8. Intellectual property
Unless otherwise indicated, the proprietary software, documentation, website text, original graphics, branding and other original materials are owned by SIS TELECOM SRL.
All rights not expressly granted under these terms are reserved.
Osclass, Joomla, Stripe and other third-party names and trademarks belong to their respective owners. References to them indicate compatibility or integration and do not imply endorsement unless expressly stated.
9. Updates and support
Unless the product page states otherwise, a paid software purchase includes product updates for 12 months from the purchase date.
After the update period expires:
-
your licence to use the version lawfully downloaded does not expire, unless the product was expressly sold as a subscription;
-
access to new versions or continued update services may require renewal or another purchase;
-
you should retain your own backup of the latest version downloaded during the update period.
Updates may include bug fixes, compatibility improvements, security changes and reasonable feature improvements. They do not necessarily include separately released products, bespoke development or major services not described on the product page.
Support, where included, covers reasonable assistance with installation, configuration and reproducible product issues. It does not include unrelated platform problems, third-party extension conflicts, custom development or administration of the customer’s website unless separately agreed.
10. Right of withdrawal for digital content
Consumers purchasing online generally have a 14-day right of withdrawal, subject to the rules applicable to digital content.
If you request immediate access to a digital product and expressly acknowledge that your right of withdrawal will be lost when the download begins, the statutory right of withdrawal ends once the download or other digital delivery begins.
If immediate access has not been requested and the download has not begun, an eligible consumer may exercise the applicable right of withdrawal by contacting us within the statutory period.
This rule does not limit rights relating to digital content that is faulty, misdescribed or otherwise not in conformity with the contract.
The statutory consumer right of withdrawal does not apply to purchases made exclusively in the course of a trade, business or profession where the purchaser is not legally considered a consumer.
11. Refunds and non-conforming products
A refund may be provided where required by law, including where a product cannot be supplied or is not brought into conformity within a reasonable period.
Before requesting a refund for a technical problem, you should provide sufficient information to reproduce the issue and allow us a reasonable opportunity to investigate, repair, replace or update the product.
A refund is not normally due solely because:

you changed your mind after downloading the product with the required acknowledgement;
-
you did not check clearly stated compatibility requirements;
-
your website uses an unsupported platform version;
-
the issue is caused by an unrelated theme, extension, server restriction or unauthorised modification;
-
you no longer need the product.
Nothing in these terms excludes mandatory consumer rights or remedies for non-conforming digital content.
12. Customer responsibilities
You are responsible for maintaining appropriate backups and testing software on a private staging website before using it on a live production website.
Before installing or updating a product, you should:
-
confirm platform and PHP compatibility;
-
back up the website and database;
-
review the included documentation;
-
test compatibility with important third-party extensions;
-
comply with applicable privacy, consumer, security and content laws.
A plugin or theme is a technical tool. Its use does not by itself make a customer’s website legally compliant.
13. Community Forum
A TictacBazar.com account may also provide access to the TTB Community Forum.
You retain ownership of original content you post. By publishing content, you grant SIS TELECOM SRL a non-exclusive licence to host, display, format and reproduce that content as necessary to operate and moderate the forum.
You must not post content that is unlawful, threatening, abusive, deceptive, defamatory, infringing, malicious, confidential without authorisation, or intended primarily as spam.
We may edit, move, lock or remove forum content and may restrict forum access where reasonably necessary to enforce these rules, protect users or comply with legal obligations.
14. Service availability
We aim to keep the website, customer accounts and downloads available, but uninterrupted operation cannot be guaranteed.
We may temporarily suspend access for maintenance, security work, legal compliance or circumstances outside our reasonable control.
Where a purchased product is affected, we will take reasonable steps to restore access or provide an appropriate alternative.
15. Disclaimer and limitation of liability
Products are supplied with the features and compatibility described on their product pages.
To the maximum extent permitted by law, we are not responsible for indirect or consequential losses resulting from unsupported configurations, third-party services, unauthorised modifications, failure to maintain backups or use outside the product’s documented purpose.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights, fraud, wilful misconduct or liability otherwise protected by applicable law.
16. Suspension and termination
We may suspend account, forum or download access where there is reasonable evidence of:

account compromise;
-
payment fraud;
-
unauthorised redistribution;
-
abuse of download systems;
-
unlawful activity;
-
serious or repeated violation of these terms.
Where appropriate, we will provide notice and an opportunity to resolve the issue. Suspension does not remove any mandatory legal rights.

18. Governing law and disputes
These terms are governed by Romanian law.
If you are a consumer, this choice does not deprive you of mandatory consumer protections provided by the law of your country of habitual residence.

Nothing in this section prevents either party from using a competent court or another remedy available under applicable law.
19. Changes to these terms
We may update these terms to reflect legal, technical or commercial changes.
The version applicable to an order is the version presented or made available when that order is placed. Material changes will not retroactively remove rights already granted under an accepted order.
20. Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue to apply. The affected provision will be interpreted or replaced to the minimum extent necessary to make it lawful and enforceable.
